GENERAL PHOTOGRAPHY AGREEMENT

This Agreement is entered into between:

• Photographer: Ksenia Vasileva (“Photographer”)
• Client: (“Client”)

By booking a session with the Photographer, the Client agrees to the following terms and conditions:

1. SCOPE OF SERVICES

The Photographer agrees to provide professional photography services as per the session type selected by the Client. Services include:
• A photography session at an agreed location and date.
• Professional editing of selected images.
• Digital delivery of final images within the standard turnaround time.
If any technical difficulties arise, the delivery time may take a little longer than originally stated.

2. PAYMENT & FEES

• A non-refundable deposit is required to secure the session date.
• The remaining balance must be paid before or on the day of the session.
• No images will be delivered until full payment is received.

3. USAGE RIGHTS & LICENSING

• Personal Use: The Client receives personal usage rights for the delivered images. This includes printing, sharing with friends and family, and posting on social media with credit to the Photographer.
• Commercial Use: If the images are to be used for business, branding, marketing, or website purposes, a separate commercial licensing fee will apply. The Client must notify the Photographer in advance if the images will be used commercially.
• Copyright: All images remain the property of the Photographer. The Client may not alter, edit, sell, or claim ownership of the images.

4. RESCHEDULING & CANCELLATIONS

• If the Client needs to reschedule, they must notify the Photographer at least 2 days in advance.
• Sessions rescheduled due to weather or unforeseen circumstances will be moved to the next available date.
• If the Client cancels the session, the deposit is non-refundable.

5. MODEL RELEASE & IMAGE USAGE

• By booking a session, the Client grants the Photographer permission to use selected images for portfolio, website, and promotional purposes, including but not limited to advertising, social media, websites, and print materials.
• Opt-Out Option: The Client may choose to decline image usage for promotional purposes. In this case, an additional fee will apply, which must be agreed upon before the session.

6. LIABILITY & INDEMNIFICATION

• The Photographer is not responsible for unforeseen circumstances such as weather, venue restrictions, or technical failures.
• The Photographer is not liable for any injuries, property damage, or loss that may occur during the session.
• The Client agrees to release the Photographer from any claims, damages, or losses that may arise as a result of participating in the session.

7. RESPECT DURING THE SESSION

• The Client agrees to maintain a respectful and cooperative attitude during the photo session.
• This ensures a positive and stress-free environment where the Photographer can provide their best work.
• In the event of clear disrespect or behavior that disrupts the Photographer’s creative process, the Photographer reserves the right to pause or discontinue the session.

8. USE OF IMAGES FOR ADVERTISING & PROMOTION

• The Client acknowledges that the Photographer normally has the right to use their images in advertising, exhibitions, and for marketing purposes both online and offline, including but not limited to social media, websites, blogs, and printed materials.
• If the Client chooses the Opt-Out Option (see Section 5), the Photographer will respect the Client’s decision and will not use their images for advertising, exhibitions, or promotional purposes.

By proceeding with the booking, the Client confirms that they have read, understood, and agreed to the terms of this Agreement, including consent for image processing and editing at the Photographer’s discretion, and that they will not alter, edit, or manipulate the images in any way.
